1. About these terms
PROFID is a brand of EPASS Inc., a Delaware corporation (EPASS Inc. d/b/a PROFID). These Terms of Use apply to the public PROFID website at https://theprofid.com. By using the website, you agree to these terms to the extent permitted by law.
Client accounts and screening services are governed by the client’s Master Services Agreement. A candidate account is governed by these terms, the Privacy Policy, and the disclosures and authorization you received from the employer. Nothing in a candidate account limits your rights under the FCRA or state law. These terms do not authorize anyone to obtain a report about you.
2. Your consumer rights
Nothing in these terms limits or waives your rights under the Fair Credit Reporting Act (FCRA) or applicable state law. This includes your rights to see your file, receive required notices, dispute inaccurate or incomplete information, and seek remedies provided by law. You do not have to agree to these terms to exercise those rights.
To obtain your file, visit Request Your File. To challenge information, visit Dispute a Report.
3. Permitted use
You may use the website for lawful purposes, including learning about PROFID, contacting us, and accessing information and request forms intended for you. You may save or print information provided for your personal use, including notices and information about your consumer rights.
4. Prohibited use
You must not:
- Access or attempt to access another person’s report, account, or personal information without lawful authority.
- Circumvent access controls or interfere with the website’s security or operation.
- Scrape, harvest, or systematically extract website content or personal information without authorization.
- Reverse engineer website software, except where applicable law permits this despite a contractual restriction.
- Upload malware, submit fraudulent information, impersonate another person, or use the website for an unlawful purpose.
These restrictions do not prevent you from obtaining your own file, preserving evidence, making a good-faith dispute or complaint, or exercising another legal right.
5. Intellectual property
Website content, software, and design are owned by EPASS Inc. or their respective owners and are protected by applicable intellectual property laws. PROFID and the PROFID logo are trademarks of EPASS Inc. Other names and marks belong to their respective owners. Nothing on the website grants a license to use these marks, and website access does not transfer ownership or grant a license beyond the permitted uses described here or rights provided by law.
6. Information and third-party links
Website information is provided for general information and is not legal advice. A description of a service does not mean that every check is available or legally permitted for every employer, position, or location.
Links to other websites are provided for convenience. Their operators control their content and terms. A link does not imply endorsement. Our handling of personal information is described in the Privacy Policy, California Privacy Notice, and Biometric Policy.
7. Website availability and liability
To the extent permitted by law, the public website and its general informational content are provided “as is” and “as available,” without warranties of uninterrupted availability or fitness for a particular purpose. We may maintain, change, or temporarily suspend website features.
To the extent permitted by law, EPASS Inc. is not liable for indirect or consequential loss arising solely from use of general public website content. This limitation does not apply to consumer reporting services, the handling of personal information, fraud, gross negligence, willful misconduct, or any liability that cannot lawfully be excluded or limited. It does not limit statutory damages, other remedies, or duties under the FCRA or applicable state law. Website changes or unavailability do not remove our legal duties to respond to consumer requests.
8. Governing law and venue
These Terms of Use are governed by the laws of the State of California, without regard to its conflict-of-law rules, and by applicable federal law. Any dispute arising from use of the public website that is not resolved informally will be brought in the state or federal courts located in San Diego County, California, and you and EPASS Inc. consent to their jurisdiction. This clause does not apply to claims under the Fair Credit Reporting Act or state consumer reporting law, which you may bring wherever those laws allow, and it does not override any consumer protection law of the state where you live that cannot be waived by contract. These terms contain no arbitration agreement and no class-action waiver.
9. Changes
We may update these terms by posting a revised version and changing the effective date. Changes apply prospectively to website use to the extent permitted by law. They do not reduce rights or alter claims that arose before the change.
